Official Rules

This Promotion is sponsored by Newton Federal Bank, a division of Affinity Bank (“Sponsor”) and is governed by these Official Rules (“Official Rules”). By participating in this Promotion, each entrant agrees to abide by these Official Rules, including all eligibly requirements, and understands that the results of the Promotion, as determined by Sponsor and its agents, are final in all respects. The Promotion is subject to all federal, state, and local laws and regulations and is void where prohibited by law. 

ELIGIBILITY
The Promotion is open to new and current Newton Federal Bank checking account owners with active Newton Federal Bank branded debit cards. A Newton Federal Bank branded debit card is required for entry. Participants must be legal U.S. residents who are at least 18 years of age or the age of majority in their state of residence, as of the date of entry to participate. 

Employees of Affinity Bank and the Bank’s Holding Company are not eligible to participate, which includes all members of the Board of Directors. Immediate family members of employees are not eligible to participate. Sponsor has the right to verify the eligibility of each entrant. 

PROMOTION PERIOD
Promotion Period will run from date of posting (July 1, 2022) until (August 31, 2022) at 11:59 p.m. EST. 

All transaction entries must be posted and settled to the account on or before the end of the Promotion Period run time, as stated. Sponsor reserves the right to extend or shorten the Promotion at its sole discretion. 

HOW TO ENTER
Each Newton Federal Bank branded debit card transaction over $5.00 that posts and settles to an open, current Newton Federal Bank checking account will automatically earn one (1) entry into the Promotion.  There is no entry limit per person.  ATM transactions of any amount, conducted at any ATM, do not count for entry into this Promotion.

SUBMISSION MATERIAL
Any information collected from this Promotion will only be used to notify the winner.

The Sponsor reserves the right, in its sole discretion, to disqualify any individual who is found: (i) to be tampering with the entry process or the operation of the Promotion; (ii) to be acting in violation of the Official Rules; or (iii) to be acting in an un-sportsmanlike or disruptive manner; (iv) or to be engaging in any other offensive conduct that jeopardizes the integrity and/or administration of the Promotion, which shall be determined at the Sponsor’s sole discretion. Sponsor reserves the right to cancel or modify the Promotion if fraud or technical problems question the integrity of the Promotion.

WINNER SELECTION
The winner(s) will be determined based on the most posted transactions to a single checking account during the Promotion Period within a week of the Promotion Period closing. The winner will be notified via one or more of the following methods: phone call, email, or U.S mail using information the Newton Federal Bank has on file. The winner(s) has 72 hours to claim the prize in person from the time we publicly announce they are the winner. In the event the winner(s) fail to claim their prize with 72 hours, the prize will be mailed to the winner(s). In the case of a winner’s disqualification, the account with the next most entries from the pool of remaining qualified entries. Winners are responsible for any federal, state, or local taxes and we may require a completed W-9. If a potential winner fails to comply with these Official Rules, that potential winner will be disqualified.

PRIZE
The top three (3) checking accounts with the most posted transaction will be awarded prizes as follows:

1^st place = $500 gift card 
2^nd place = $300 gift card
3^rd place = $200 gift card

The odds of being the prize Promotion winner depends on the total number of eligible entries received. 

Prizes will be available either by pick up at the Main Office of Newton Federal Bank or by U.S. mail. Each winner will be required to provide legal identification before claiming a prize. Sponsor will pay for the postage if the prize is mailed. No responsibility is assumed by the Sponsor for any postal mail or delivery returned as undeliverable without a forwarding address or after the prize has been mailed.

NOTICE
This Promotion is not endorsed by any issuer of the prize gift cards.

CONSENT TO PUBLICITY AND RELEASE
By accepting a prize in this Promotion, winner consents to permit Newton Federal Bank to utilize his/her name and likeness in promotional and other Bank materials, without additional compensation or permission, except where prohibited by law. All entrants agree to release Newton Federal Bank, its respective parents, affiliates, and all of its directors, employees, agents and assigns of any and all claims arising directly or indirectly from this Promotion, and Promotion Prize or from any publicity about the Promotion.

GOVERNING LAW & JURISDICTION
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and Newton Federal Bank in connection with the Promotion will be governed by and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law. The state and federal courts located in Newton County, Georgia will be the exclusive forum for any dispute relating to these Official Rules and/or this Promotion. All participants and winner(s) agree, by their participation in the Promotion, to submit to the personal jurisdiction of the state and federal courts in Newton County, Georgia and waive the right to contest jurisdiction.
